Survey for U.S. persons with outbound foreign investments

The U.S. Department of Commerce is once again conducting its Benchmark Survey of U.S. Direct Investment Abroad. The survey is generated once every five years and is mandatory for all U.S. persons that own, whether directly or indirectly, 10% or more of the voting securities of an incorporated foreign business enterprise, or an equivalent interest in an unincorporated foreign business enterprise.

The survey is intended for U.S. persons with outbound foreign investments. The term “U.S. person” in this case, includes individuals, as well as business entities; however U.S. citizens that reside outside the United States are generally exempt.

This filing requirement is mandatory and regulated under U.S. law. Failure to report is subject to penalties that can range from $2,500 to $25,000 in fines.
